欢迎使用 MBAICD。本协议是您与深圳市亿昇佳科技有限公司（以下称“我们”）之间关于使用 MBAICD 移动应用及相关服务的约定。请在使用前认真阅读，特别是以粗体提示的条款。
重要说明：MBAICD 用于浏览和订购手机屏、电池等实体商品，不提供需通过 Apple App 内购买解锁的数字内容。Apple 不是交易卖方，也不负责商品、配送或客户支持。
1. 接受协议
当您访问、登录、创建账号、提交订单或继续使用服务，即表示您已阅读并同意本协议及隐私政策。如您不同意，请停止使用。若您代表企业使用服务，您确认有权使该企业受本协议约束。
2. 使用资格与未成年人
您应具备适用法律要求的民事行为能力。未成年人须在父母或法定监护人阅读并同意本协议后，在其指导下使用和下单。服务不面向14周岁以下儿童独立使用。
3. 访客会话与账号
- 您可通过访客会话浏览部分内容；订单、收藏、地址、消息或客服等功能可能要求登录。
- 登录时，系统可能根据您提交的用户名创建账号。您应提供准确资料，不冒用他人身份，并及时更新联系方式和收货信息。
- 您应妥善保护密码和设备。除因我们原因导致外，您应对账号下的操作负责。发现未经授权使用时请立即联系客服。
- 生物识别快速登录为可选的本机功能。启用后，登录凭据存于设备安全存储；共享设备时请谨慎开启。
4. 服务内容
服务包括手机部件展示、型号或适配信息、搜索、收藏、购物车、订单提交、物流状态、订单文件、消息和客户支持。具体功能以当前 App 为准。我们可为安全、维护或业务需要调整功能，但不会排除您依法已享有的权利。
5. 商品信息与兼容性
- 我们尽力确保名称、图片、规格、适配型号、库存和描述准确，但设备显示、批次或合理更新可能导致细微差异。
- 手机部件对型号、版本和安装工艺有特定要求。下单前请核对完整机型、规格、接口和数量；如不确定，请先联系客服。
- 除非明确说明，提及的手机厂商名称和商标仅用于兼容性识别，不表示相关厂商对商品或服务的赞助、认可或隶属关系。
6. 订单成立、价格与库存
- 将商品加入购物车不构成预留或购买合同。提交订单是您的购买要约；订单经我们确认接受或开始履行后成立，但适用法律另有规定的除外。
- 下单前请检查商品、数量、地址和备注。适用价格、币种、税费、运费及结算方式以确认页面或双方确认的信息为准。
- 如出现明显价格/描述错误、缺货、无法配送、涉嫌欺诈或法律限制，我们可在及时通知后拒绝或取消订单，并按适用规则退还已收款项。
- App 当前交易对象为实体商品；结算如通过 App 外的可用方式完成，不属于 Apple App 内购买，Apple 不是付款或退款责任方。
7. 订单变更与取消
在订单尚未进入不可撤回的履约阶段时，您可使用 App 提供的取消功能。已发货、定制、拆封或其他情形能否取消，取决于商品性质、订单状态及适用消费者法律。如我们取消订单，会通过 App 或您提供的联系方式通知。
8. 配送与验收
- 您应提供完整准确且可联系的收货信息，并确保有权使用该地址。因信息错误、无人签收或超出配送范围产生的延误可能由您承担。
- 显示的到货时间和物流节点通常为估计或来自承运人，不构成绝对保证，但法律明确规定的除外。
- 收货时请检查外包装、数量和明显损坏；发现异常请保留包装、照片和物流凭证并尽快联系客服。
9. 退换、退款与法定保障
退换、退款、质量保证和售后处理以订单页面公布的规则、商品性质、双方约定及您所在地强制性消费者法律为准。您可通过应用内客服提交问题并提供订单号及必要证据。本协议不限制或排除依法不得放弃的退货、退款、维修、更换或质量保障权利。
10. 安装与安全提示
手机屏、电池等部件可能涉及拆机、专用工具、静电、尖锐部件或锂电池风险。请遵循产品说明并由具备相应技能的人员安装。电池鼓包、破损、漏液或过热时应停止使用并按当地规定处置。因未遵循说明、不兼容改装或不当安装造成的损害，按适用法律确定责任。
11. 用户行为规范
您不得：
- 违法、欺诈、侵犯知识产权、冒用身份或侵害他人权益；
- 提交恶意代码、攻击、抓取、逆向工程或干扰 App、API、账号和安全措施，但法律明确允许的除外；
- 批量创建虚假账号或订单、滥用优惠、发送垃圾或违法客服内容；
- 未经授权转售访问权限，或利用服务从事受制裁、出口管制或其他法律禁止的交易。
我们可删除违法内容、限制相关功能或暂停账号，并在合理可行时说明原因和提供申诉渠道。
12. 知识产权
App 的软件、界面、文字、图形、品牌和汇编内容由我们或许可方所有，并受法律保护。我们授予您一项个人、有限、可撤销、非独占、不可转让的许可，仅用于在您拥有或控制的 Apple/Android 设备上正常使用服务，并受适用商店规则约束。您对主动提交的内容保留权利，并授权我们在提供服务所必需范围内托管、复制和展示该内容。
13. 第三方服务
物流、推送、托管、系统分享或外部链接可能由第三方提供，并受其条款约束。我们会依法选择和管理服务商，但不控制第三方独立提供的服务。通过系统分享订单 PDF 时，您选择的接收应用将按其自己的规则处理文件。
14. 服务可用性、免责声明与责任限制
我们努力保持服务安全可用，但维护、网络、设备兼容、不可抗力或第三方故障可能造成中断。在法律允许的最大范围内，服务按“现状”和“可用”状态提供；我们不作适销性、特定用途适用性或不间断运行的默示保证。任何免责或责任限制均不适用于因故意或重大过失造成的责任、产品责任、人身伤害、欺诈，以及消费者法律禁止限制的权利。
在法律允许的范围内，我们不对不可合理预见的间接或后果性损失负责。对于可依法限制的直接损失，我们的累计责任不超过引发请求的相关订单金额；若请求与订单无关，则不超过您提出请求前12个月为服务实际支付的金额。适用法律要求更高责任的，从其规定。
15. 隐私与账号注销
我们按照隐私政策处理个人信息。您可在“设置—注销账号”发起注销，或联系客服。注销不会自动撤销已经成立的订单、未完成的履约义务或依法必须保存的交易记录；可删除的数据将在核验和处理完成后删除或匿名化。
16. 暂停、终止与协议更新
您可随时停止使用。若您严重违反本协议、危害安全或法律要求，我们可暂停或终止相关服务。我们可能因功能或法律变化更新协议；重大不利变更将以适当方式提示。变更生效后继续使用表示接受，但需要单独同意或法律另有规定的除外。
17. 适用法律与争议解决
本协议适用中华人民共和国法律（不含冲突法规则）。争议应先通过客服友好协商；协商不成，可向深圳市亿昇佳科技有限公司所在地有管辖权的人民法院起诉。如您作为消费者所在地的强制性法律赋予您不可放弃的保护或其他管辖权，本条不影响该等权利。
18. Apple App Store 特别条款
- 本协议仅在您与我们之间订立，而非与 Apple 订立；我们而非 Apple 对 App、商品和内容负责。
- Apple 没有为 App 提供维护或支持的义务。法律要求的任何 App 保证由我们负责；如 App 未满足适用保证，您可通知 Apple，Apple 可按其规则退还 App 的购买价（本 App 通常为免费下载），在法律允许范围内 Apple 不承担其他保证责任。
- 我们而非 Apple 负责处理与 App 或您使用 App 相关的产品责任、法规合规、消费者保护或知识产权侵权请求。
- 您声明您不位于受美国政府禁运或指定为支持恐怖主义的国家/地区，且未列入美国政府禁止或限制交易名单。
- 使用 App 时，您还应遵守适用的第三方协议和 Apple Media Services Terms and Conditions。
- Apple 及其子公司是本协议的第三方受益人；您接受本协议后，Apple 有权以第三方受益人身份向您执行相关条款。
19. 其他
如部分条款无效，其余条款继续有效。我们未立即执行某项权利不构成放弃。未经我们书面同意，您不得转让本协议；我们可在合并、重组或业务转让时依法转让，并通知受影响用户。标题仅为阅读方便。

Terms of Use
Updated and effective: September 5, 2026
Welcome to MBAICD. These Terms form an agreement between you and Shenzhen Yishengjia Technology Co., Ltd. (“we,” “us,” or “our”) for the MBAICD mobile application and related services. Please read them carefully.
Important: MBAICD is used to browse and order physical goods such as mobile phone screens and batteries. It does not offer digital content unlocked through Apple In-App Purchase. Apple is not the seller and is not responsible for goods, delivery, or support.
1. Acceptance
By accessing, signing in, creating an account, submitting an order, or continuing to use the Services, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Services. If you act for a business, you confirm authority to bind it.
2. Eligibility and minors
You must have the legal capacity required where you live. A minor may use and order through the Services only under the guidance of a parent or legal guardian who has reviewed and accepted these Terms. The Services are not intended for independent use by children under 14.
3. Guest sessions and accounts
- You may browse some content through a guest session. Orders, favorites, addresses, messages, or support may require sign-in.
- The system may create an account from the username you submit when signing in. Provide accurate details, do not impersonate another person, and keep contact and shipping details current.
- Protect your password and device. Except where caused by us, you are responsible for activity under your account. Promptly report unauthorized use.
- Biometric quick login is an optional on-device feature. Credentials are held in secure device storage when enabled; use caution on shared devices.
4. Services
The Services may include product and compatibility information, search, favorites, cart, order submission, shipment status, order documents, messages, and support. Current App functionality controls. We may adjust features for security, maintenance, or business needs without excluding rights you already have by law.
5. Product information and compatibility
- We work to keep names, images, specifications, compatibility, inventory, and descriptions accurate, but displays, production batches, and reasonable updates may cause minor differences.
- Mobile parts may require an exact model, version, connector, and installation method. Verify the complete model, specifications, and quantity before ordering; contact support if unsure.
- Unless expressly stated, manufacturer names and marks identify compatibility only and do not imply sponsorship, endorsement, or affiliation.
6. Order formation, prices, and inventory
- Adding an item to the cart does not reserve it or create a purchase contract. Submitting an order is your offer; a contract forms when we accept or begin fulfillment, unless applicable law provides otherwise.
- Review the item, quantity, address, and notes. Price, currency, tax, shipping charge, and settlement method are those shown at confirmation or otherwise agreed.
- We may reject or cancel after notice for an obvious price/description error, lack of stock, inability to deliver, suspected fraud, or legal restriction, and refund amounts already collected under applicable rules.
- App transactions concern physical goods. Settlement through an available method outside the App is not Apple In-App Purchase, and Apple has no payment or refund responsibility.
7. Changes and cancellation
You may use the available cancellation function before an order reaches an irreversible fulfillment stage. Whether shipped, customized, opened, or other goods can be cancelled depends on product type, order status, and mandatory consumer law. We will notify you if we cancel.
8. Delivery and inspection
- Provide complete, accurate, reachable delivery details and ensure you may use the address. You may bear delay caused by incorrect details, failed receipt, or an out-of-range address.
- Delivery estimates and carrier tracking are generally estimates, not absolute guarantees unless law says otherwise.
- Inspect packaging, quantity, and visible damage on receipt. Keep packaging, photos, and carrier evidence and contact support promptly if there is a problem.
9. Returns, refunds, and statutory guarantees
Returns, refunds, quality guarantees, and after-sales handling depend on published order rules, product nature, our agreement, and mandatory law where you live. Contact in-app support with the order number and necessary evidence. Nothing in these Terms excludes non-waivable rights to return, refund, repair, replacement, or product quality remedies.
10. Installation and safety
Screens, batteries, and similar parts may involve disassembly, specialized tools, static electricity, sharp parts, or lithium battery hazards. Follow instructions and use a suitably skilled installer. Stop using swollen, damaged, leaking, or overheating batteries and dispose of them under local rules. Liability for failure to follow instructions, incompatible modification, or improper installation is determined under applicable law.
11. Acceptable use
You must not:
- Act illegally or fraudulently, infringe intellectual property, impersonate others, or violate their rights;
- Submit malware, attack, scrape, reverse engineer, or interfere with the App, APIs, accounts, or security except where law expressly permits;
- Create fake accounts or orders in bulk, abuse offers, or send spam or unlawful support content;
- Resell access without authorization or use the Services for sanctioned, export-controlled, or prohibited transactions.
We may remove unlawful content, restrict functions, or suspend an account and, where reasonably possible, explain the reason and provide a review route.
12. Intellectual property
The App software, interface, text, graphics, brands, and compilations belong to us or our licensors and are protected by law. We grant a personal, limited, revocable, non-exclusive, non-transferable license to use the App normally on Apple/Android devices you own or control, subject to applicable store rules. You retain rights in your content and license us to host, copy, and display it only as needed to provide the Services.
13. Third-party services
Logistics, push delivery, hosting, system sharing, and external links may be supplied by third parties under their terms. We select and manage providers as required by law but do not control independently offered services. If you share an order PDF through the operating system, your chosen receiving app handles it under its own rules.
14. Availability, disclaimers, and liability
We work to keep the Services secure and available, but maintenance, networks, device compatibility, force majeure, or provider failures may interrupt them. To the maximum extent allowed, the Services are provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, or uninterrupted operation. No exclusion or limit applies to willful misconduct or gross negligence, product liability, personal injury, fraud, or a consumer right that cannot lawfully be limited.
Where lawful, we are not responsible for indirect or consequential losses that were not reasonably foreseeable. For direct loss that may lawfully be limited, aggregate liability will not exceed the relevant order amount or, for a non-order claim, the amount you actually paid for the Services in the preceding 12 months. Higher mandatory liability remains unaffected.
15. Privacy and account deletion
We process information under the Privacy Policy. You may initiate deletion under Settings → Delete Account or contact support. Deletion does not cancel a formed order, unfinished obligations, or legally retained transaction records; eligible data is deleted or anonymized after verification and processing.
16. Suspension, termination, and updates
You may stop using the Services at any time. We may suspend or terminate relevant Services for a material breach, security risk, or legal requirement. We may update these Terms for feature or legal changes and will give appropriate notice of materially adverse changes. Continued use after effectiveness means acceptance unless separate consent is required.
17. Governing law and disputes
These Terms are governed by the laws of the People’s Republic of China, without conflict-of-law rules. Contact support first for good-faith resolution; unresolved disputes may be brought before a competent court where Shenzhen Yishengjia Technology Co., Ltd. is located. This does not remove mandatory consumer protections or jurisdiction rights in your place of residence.
18. Apple App Store terms
- These Terms are between you and us, not Apple. We, not Apple, are responsible for the App, goods, and content.
- Apple has no duty to provide maintenance or support. We are responsible for any App warranty required by law. If the App fails an applicable warranty, you may notify Apple, which may refund the App purchase price under its rules (the App is normally free); to the extent permitted, Apple has no other warranty obligation.
- We, not Apple, handle product liability, regulatory, consumer-protection, or intellectual-property claims relating to the App or your use.
- You represent that you are not in a country subject to a U.S. Government embargo or designated as supporting terrorism and are not on a U.S. Government prohibited or restricted-party list.
- You must comply with applicable third-party agreements and the Apple Media Services Terms and Conditions.
- Apple and its subsidiaries are third-party beneficiaries and, upon acceptance, may enforce the relevant Terms against you as such.
19. General
If a provision is invalid, the rest remains effective. Delay in enforcement is not a waiver. You may not assign these Terms without written consent; we may lawfully assign them in a merger, reorganization, or business transfer with notice to affected users. Headings are for convenience.

مهم: يستخدم MBAICD لتصفح وطلب سلع مادية مثل شاشات وبطاريات الهواتف، ولا يقدم محتوى رقميًا يفتح عبر الشراء داخل تطبيق Apple. وليست Apple البائع ولا تتحمل مسؤولية السلع أو التوصيل أو الدعم.
1. قبول الشروط
باستخدام الخدمات أو تسجيل الدخول أو إنشاء حساب أو تقديم طلب فإنك توافق على هذه الشروط وسياسة الخصوصية. إذا لم توافق فتوقف عن الاستخدام. وإذا استخدمتها نيابة عن شركة فأنت تؤكد صلاحيتك لإلزامها.
2. الأهلية والقاصرون
يجب أن تتمتع بالأهلية القانونية المطلوبة في محل إقامتك. لا يجوز للقاصر الاستخدام والطلب إلا بتوجيه ولي الأمر الذي قرأ الشروط ووافق عليها. الخدمات غير موجهة للاستخدام المستقل لمن هم دون 14 عامًا.
3. جلسات الضيف والحساب
- يمكن تصفح بعض المحتوى كضيف، وقد يتطلب الطلب والمفضلة والعناوين والرسائل والدعم تسجيل الدخول.
- قد ينشئ النظام حسابًا من اسم المستخدم الذي تقدمه. قدم معلومات صحيحة ولا تنتحل شخصية غيرك وحدّث معلومات الاتصال والشحن.
- احم كلمة المرور والجهاز. وباستثناء ما نتسبب فيه، تتحمل مسؤولية نشاط حسابك. أبلغ الدعم فورًا عن الاستخدام غير المصرح.
- الدخول البيومتري ميزة اختيارية على الجهاز، وتحفظ بيانات الدخول في التخزين الآمن عند تفعيلها؛ فاحذر على الأجهزة المشتركة.
4. الخدمات
قد تشمل الخدمات معلومات المنتجات والتوافق والبحث والمفضلة والسلة وتقديم الطلب وحالة الشحن ومستندات الطلب والرسائل والدعم. تعتمد الوظائف المتاحة على الإصدار الحالي. وقد نعدلها للأمان أو الصيانة أو حاجة العمل دون إسقاط حقوقك القانونية.
5. معلومات المنتج والتوافق
- نسعى لدقة الأسماء والصور والمواصفات والتوافق والمخزون والوصف، لكن العرض أو دفعات الإنتاج أو التحديثات قد تسبب فروقًا طفيفة.
- قد تتطلب قطع الهاتف طرازًا وإصدارًا وموصلًا وطريقة تركيب دقيقة. تحقق من الطراز الكامل والمواصفات والكمية قبل الطلب واتصل بالدعم إن لم تكن متأكدًا.
- ما لم نذكر خلاف ذلك، تستخدم أسماء وعلامات المصنعين لتعريف التوافق فقط ولا تعني الرعاية أو الاعتماد أو الانتساب.
6. تكوين الطلب والأسعار والمخزون
- إضافة المنتج للسلة لا تحجزه ولا تنشئ عقد شراء. تقديم الطلب عرض منك، وينشأ العقد عند قبولنا أو بدء التنفيذ ما لم ينص القانون على غير ذلك.
- راجع المنتج والكمية والعنوان والملاحظات. السعر والعملة والضريبة والشحن وطريقة التسوية هي الظاهرة في التأكيد أو المتفق عليها.
- يجوز لنا بعد إشعارك رفض أو إلغاء طلب بسبب خطأ واضح أو نفاد المخزون أو تعذر التوصيل أو الاحتيال المشتبه أو قيد قانوني، مع رد المبالغ المحصلة وفق القواعد.
- المعاملات تخص سلعًا مادية. التسوية بطريقة متاحة خارج التطبيق ليست شراءً داخل تطبيق Apple، ولا تتحمل Apple مسؤولية الدفع أو الاسترداد.
7. تعديل الطلب وإلغاؤه
يمكن استخدام الإلغاء المتاح قبل بلوغ مرحلة تنفيذ لا يمكن الرجوع عنها. وتعتمد إمكانية إلغاء السلع المشحونة أو المخصصة أو المفتوحة على طبيعتها وحالة الطلب وقانون المستهلك الإلزامي. سنخطرك إذا ألغينا الطلب.
8. التوصيل والفحص
- قدم معلومات توصيل كاملة وصحيحة وقابلة للاتصال وتأكد من حقك في استخدام العنوان. وقد تتحمل التأخير الناتج عن الخطأ أو عدم الاستلام أو خروج العنوان عن النطاق.
- أوقات التوصيل وتتبع الناقل تقديرية عادة وليست ضمانًا مطلقًا إلا إذا أوجب القانون ذلك.
- افحص التغليف والكمية والضرر الظاهر عند الاستلام، واحتفظ بالتغليف والصور وإثبات الناقل واتصل بالدعم سريعًا عند المشكلة.
9. الإرجاع والاسترداد والضمان القانوني
تعتمد معالجة الإرجاع والاسترداد وضمان الجودة وما بعد البيع على قواعد الطلب المنشورة وطبيعة المنتج والاتفاق والقانون الإلزامي في بلدك. تواصل مع الدعم وارفق رقم الطلب والدليل اللازم. لا تستبعد الشروط أي حق غير قابل للتنازل في الإرجاع أو الاسترداد أو الإصلاح أو الاستبدال أو ضمان الجودة.
10. التركيب والسلامة
قد ينطوي تركيب الشاشة أو البطارية على فك الجهاز وأدوات خاصة وكهرباء ساكنة وأجزاء حادة أو مخاطر بطارية الليثيوم. اتبع التعليمات واستعن بفني مناسب. أوقف استخدام البطارية المنتفخة أو التالفة أو المتسربة أو الساخنة وتخلص منها وفق القواعد المحلية. تحدد المسؤولية عن التركيب الخاطئ أو التعديل غير المتوافق وفق القانون.
11. الاستخدام المقبول
يحظر عليك:
- النشاط غير القانوني أو الاحتيالي أو انتهاك الملكية الفكرية أو انتحال الشخصية أو حقوق الغير؛
- إرسال برمجيات ضارة أو الهجوم أو الجمع الآلي أو الهندسة العكسية أو تعطيل التطبيق أو الواجهات أو الأمان إلا إذا أجاز القانون؛
- إنشاء حسابات أو طلبات وهمية بالجملة أو إساءة العروض أو إرسال محتوى مزعج أو غير قانوني؛
- إعادة بيع الوصول دون إذن أو استخدام الخدمة في معاملات خاضعة للعقوبات أو محظورة.
يجوز لنا إزالة المحتوى غير القانوني أو تقييد الوظائف أو تعليق الحساب، مع بيان السبب ومسار للمراجعة متى كان ذلك ممكنًا.
12. الملكية الفكرية
البرمجيات والواجهة والنصوص والرسوم والعلامات والمحتوى المجمع مملوكة لنا أو لمرخصينا ومحمية بالقانون. نمنحك ترخيصًا شخصيًا محدودًا قابلًا للإلغاء وغير حصري وغير قابل للتحويل لاستخدام التطبيق طبيعيًا على أجهزة Apple/Android التي تملكها أو تتحكم بها وفق قواعد المتجر. تحتفظ بحقوق محتواك وترخص لنا استضافته ونسخه وعرضه بالقدر اللازم للخدمة.
13. خدمات الأطراف الثالثة
قد يقدم الغير الخدمات اللوجستية والإشعارات والاستضافة والمشاركة وروابط الخارج وفق شروطهم. نختار المزودين ونديرهم حسب القانون لكن لا نتحكم في خدماتهم المستقلة. وعند مشاركة ملف PDF للطلب يعالجه التطبيق الذي تختاره وفق قواعده.
14. التوفر وإخلاء المسؤولية وحدودها
نسعى إلى الأمان والتوفر، لكن الصيانة أو الشبكات أو توافق الجهاز أو القوة القاهرة أو فشل المزود قد تقطع الخدمة. لأقصى حد يسمح به القانون تقدم الخدمة «كما هي» و«حسب التوفر» دون ضمان ضمني للقابلية للتسويق أو غرض معين أو عدم الانقطاع. لا يسري أي استبعاد أو حد على التعمد أو الإهمال الجسيم أو مسؤولية المنتج أو الإصابة أو الاحتيال أو حق مستهلك لا يجوز تقييده.
حيث يسمح القانون لا نتحمل خسارة غير مباشرة أو تبعية غير متوقعة بصورة معقولة. وحد المسؤولية المباشرة القابل للتقييد هو مبلغ الطلب المعني، أو المبلغ المدفوع فعليًا للخدمات خلال 12 شهرًا السابقة إذا لم تتعلق المطالبة بطلب. ولا تتأثر المسؤولية الإلزامية الأعلى.
15. الخصوصية وحذف الحساب
نعالج المعلومات وفق سياسة الخصوصية. يمكنك بدء الحذف من الإعدادات ← حذف الحساب أو الاتصال بالدعم. لا يلغي الحذف طلبًا قائمًا أو التزامات غير مكتملة أو سجلات واجبة قانونًا، وتحذف البيانات المؤهلة أو تخفى هويتها بعد التحقق والمعالجة.
16. التعليق والإنهاء وتحديث الشروط
يمكنك التوقف في أي وقت. وقد نعلق أو ننهي الخدمة بسبب مخالفة جوهرية أو خطر أمني أو متطلب قانوني. ويمكن تحديث الشروط لتغير الوظائف أو القانون مع إشعار مناسب بالتغيير الجوهري الضار. استمرار الاستخدام بعد السريان قبول، ما لم تلزم موافقة منفصلة.
17. القانون والنزاعات
تخضع الشروط لقوانين جمهورية الصين الشعبية دون قواعد تنازع القوانين. تواصل مع الدعم أولًا للحل الودي، ويجوز رفع النزاع غير المحلول إلى المحكمة المختصة في مقر Shenzhen Yishengjia Technology Co., Ltd. لا يسقط ذلك حماية المستهلك الإلزامية أو حقوق الاختصاص في محل إقامتك.
18. أحكام Apple App Store
- الاتفاق بينك وبيننا وليس Apple، ونحن لا Apple مسؤولون عن التطبيق والسلع والمحتوى.
- لا تلتزم Apple بالصيانة أو الدعم. نحن مسؤولون عن ضمان التطبيق الذي يوجبه القانون. عند إخفاقه في ضمان مطبق يمكنك إخطار Apple التي قد ترد سعر شراء التطبيق وفق قواعدها (والتطبيق مجاني عادة)، ولا تتحمل Apple التزام ضمان آخر حيث يسمح القانون.
- نحن لا Apple نعالج مطالبات مسؤولية المنتج أو الامتثال أو حماية المستهلك أو الملكية الفكرية المتعلقة بالتطبيق أو استخدامك.
- تقر بأنك لست في دولة يحظرها أو يصنفها دعمًا للإرهاب حكومة الولايات المتحدة، ولست في قائمة أمريكية للأطراف المحظورة أو المقيدة.
- يجب الالتزام باتفاقات الأطراف الثالثة وشروط Apple Media Services المطبقة.
- تعد Apple وشركاتها التابعة مستفيدًا من الغير، ويحق لها بعد قبولك إنفاذ الأحكام ذات الصلة ضدك بهذه الصفة.
19. أحكام عامة
إذا بطل حكم بقي الباقي نافذًا. التأخر في الإنفاذ ليس تنازلًا. لا يجوز لك التنازل عن الاتفاق دون موافقة مكتوبة؛ ويجوز لنا نقله قانونيًا في اندماج أو إعادة تنظيم أو نقل أعمال مع إخطار المتأثرين. العناوين للتسهيل فقط.
